Thanks to legislation passed during the 2014 Virginia General Assembly, Pulaski County will be able to opt out of Virginia’s “Stormwater Management Program” and let the state continue to administer it.
The county had until April 30 to let Virginia Department of Environmental Quality (DEQ) know whether it would be opting in or out of the program, which localities viewed as another unfunded mandate from the state. During a prior General Assembly session, legislators voted to shift management of storm water runoff to localities, but did not provide funding to cover the added expense.
With the recent passage of Senate Bill 423, non-MS4 (Municipal System 4) localities that do not operate Municipal Storm Sewer Systems can now opt out of the program. Pulaski County is not an MS4 locality.
